Who qualifies for H4 EAD

Not all H4 holders can get work authorization. You qualify for H4 EAD only if your H1B spouse has an approved I-140 immigrant petition (green card petition). The I-140 approval is the trigger — your H1B spouse's priority date and Visa Bulletin position don't matter. Just having the I-140 approved is enough.

This means: if your spouse's employer has filed PERM and received an I-140 approval, you can apply for H4 EAD. If your spouse is on H1B but the employer hasn't started the green card process, you cannot get H4 EAD.

Children on H4 visa are not eligible for H4 EAD — it's available to spouses only.

Applying for H4 EAD: the process

To apply, file Form I-765 with USCIS with the eligibility category (c)(26) — H4 EAD. Required documents: completed I-765, copy of your H4 visa, copy of spouse's H1B approval, copy of spouse's I-140 approval, passport copies, and two passport photos.

Processing time as of 2026 is typically 3-6 months without premium processing. H4 EAD does not have a premium processing option through USCIS (though advocacy groups have pushed for this).

You can file concurrently with your H4 extension — USCIS allows concurrent I-539 (H4 extension) and I-765 (EAD) filing.
